Oklahoma House Bill 2459 - Everything You Need To Know

Posted on
September 12, 2025

Oklahoma House Bill 2459 recently passed, which focuses on fire safety regulations for food trucks in Oklahoma. Eligible food trucks must obtain annual permit and inspection by November 1, 2025. Here's everything you need to know.

What is the bill's goal?

The bill aims to create uniform fire safety regulations across the state. It generally prevents local jurisdictions from creating their own conflicting fire safety rules for mobile food preparation vehicles, with an exception for counties with a population exceeding 400,000.

Who does the bill apply to?

The bill's provisions apply to any mobile food preparation vehicle operating in Oklahoma that is capable of producing smoke or grease-laden vapors. This includes vehicles that use various cooking methods, such as those powered by electric energy, liquefied petroleum gas, compressed natural gas, or a combination of these fuels.

What are the bill's details and requirements?

Fire Safety Compliance: The bill requires all mobile food preparation vehicles in Oklahoma that produce smoke or grease-laden vapors to comply with the most current adopted fire codes.

Fire Extinguishers: It mandates the installation of portable fire extinguishers, including a specific requirement for a six-liter Class K-rated extinguisher for cooking equipment that uses solid fuels, animal or vegetable oils, or fats.

Inspections: The Oklahoma State Fire Marshal is given jurisdiction over these vehicles for fire and life safety code compliance. They are required to conduct annual inspections, with more frequent inspections (twice a year) in counties with a population over 400,000.

Operational Permit: After a successful inspection, the State Fire Marshal will issue an operational permit decal.

Enforcement: The Fire Marshal has the authority to revoke a vehicle's operational permit if it is deemed inherently dangerous to public health, safety, or welfare.

Expiration: The specific provisions of the bill are set to expire on January 1, 2026. After that date, all mobile food preparation vehicles must comply with the state-adopted fire codes, and the State Fire Marshal will be authorized to create rules to ensure uniform application of those codes.
